PLEASE CAREFULLY READ THIS DOCUMENT, IT IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

This Release and Waiver of Liability (the “Release”) executed on this day,March 29 - 30th, 2024, by Participant, Vendor, Sponsor or Volunteer attending the Spring Family Fun Fest (the “Attendee”) in favor of the Three Wishes Hope Foundation Inc., and Space Coast Basket Brigade (Hereinafter “SCBB”) and its affiliated companies, distributors, representatives, assigns, vendors, partners, sponsors, employees and/or any person(s), or corporation(s) acting under its permission or authority, from liability pertaining to the matters set forth below.

Attendee desires to work as a volunteer for SCBB, or join as a paid guest, Sponsor or participant and engage in the activities related to participtating in the Spring Family Fun Fest event for SCBB (the “Activities”). The Attendee understands that Activities may include lifting objects, carrying objects, loading objects, unloading objects, operating a motor vehicle, transporting baskets to the families, participation in kid activities such as bounce houses, obstacle courses, petting zoos, pony rides, ninja courses, nerf gun wars, easter egg hunts, children’s games, bungee trampolines, rock climing walls, craft stations, vendor or event set up duties, and transportation to and from events.  The Attendee  hereby freely, voluntarily, and without duress executes this Release under the following terms:

  1. Release and Waiver. Attendee does hereby release and forever discharge and hold harmless SCBB andits successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or my hereafterarise from Attendee's Activities with SCBB.

    Attendee  UNDERSTANDS THAT THIS RELEASE DISCHARGES SCBB FROM ANY LIABILITY OR CLAIM THATTHE VOLUNTEER MAY HAVE AGAINST SCBB WITH RESPECT TO ANY BODILY INJURY, PERSONALINJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER’SACTIVITIES WITH SCBB, WHETHER CAUSED BY THE NEGLIGENCE OF SCBB OR ITS OFFICERS,DIRECTORS, EMPLOYEES, OR AGENTS OR OTHERWISE. VOLUNTEER ALSO UNDERSTANDS THATSCBB DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATIONS TO PROVIDE FINANCIALASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH,OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.

  2. Medical Treatment. Attendee  does hereby release and discharge SCBB from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s Activities with SCBB.
  3. Assumption of the Risk. The Attendee  understands that the Activities may involve work that may be hazardous to the Volunteer, including but not limited to, lifting objects, carrying objects, loading objects, unloading objects, operating a motor vehicle, transporting baskets to the families, participation in kid activities such as bounce houses, obstacle courses, and transportation to and from events. Attendee  expressly and specifically assumes the risk of injury or harm in the Activities, and releases SCBB from all liability for injury, illness, death, or property damage resulting from the Activities.
  4. COVID-19 Assumption of Risk. Attendee  acknowledges that they are aware of the highly contagious nature of COVID-19. Attendee  understands and acknowledges that they are voluntarily assuming the risk by participating in events or Activities with SCBB, with knowledge that there is an inherent danger of and risk of infection and exposure to COVID-19. Volunteer acknowledges SCBB cannot guarantee Attendee  and accompanying minor child(ren) will not become infected or exposed to COVID-19 (or other infectious diseases) while in attendance or as a result of participation of events and Activities and that participation may increase the risk of contracting COVID-19. Attendee  acknowledges and understands that exposure or infection may result in serious illness, permanent disability, death, or property damage. Attendee  acknowledges that this risk may result from or be compounded by the actions, omissions, or negligence of others. Attendee accepts and assumes all risks and liability of personal injury, illness, disability, death, or property damage related to COVID-19, arising from Volunteer and accompanying minor child(ren) attending events or engaging in volunteer tasks, whether caused by the negligence of SCBB or otherwise. Attendee acknowledges that they agree that they may not make or bring any such claim against SCBB and forever release and discharge SCBB from liability under such claims.
  5. Insurance. The Attendee understands that, except as otherwise agreed to by SCBB, in writing, SCBB does not carry or maintain health, medical, or disability insurance coverage for any Attendee . Each Attendee  is expected and encourages to obtain his or her own medical or health insurance coverage.
  6. Confidentiality. Attendee  acknowledges and agrees that all information relating to: clients of the State of Florida Department of Children and Families; clients of the Children’s Home Society; and clients of any of the remaining organizations that SCBB is affiliated with, including but not limited to, AVET, Michael-Gene Foundation, Brevard County School Board, Family Promise, HeadStart, Serene Harbor, Genesis House, Healthy Start, Local Schools, Churches, is privileged and confidential. Volunteer agrees to hold all personal information confidential pursuant to applicable provisions of state and federal laws, including but not limited to the Family and Educational Rights and Privacy Act and its implementing regulations (20 U.S.C. 1232g and 34 C.F.R. Part 99) and any other applicable regulations. Volunteer further acknowledges that any person who reveals such confidential information may be held in contempt of court, liable for a criminal penalty, and/or may be civilly liable to any person harmed by the release of such information.
  7. Other. Attendee expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida. Volunteer also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
    Photo and Video: Attendee aknowledges that there will a be a professional photographer and videographer capturing the event and that photos and videos will be published on our website, social media pages and throughout various social media groups and platforms. Attendee agrees to having their image / their child's image used for all media publications and understands that all photos and videos are property and rights to SCBB.

BY PARTICIPATING IN THIS EVENT YOU ACKNOWLEDGE TO HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT YOU ARE VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS.
